This is sold through a 3rd party Walmart seller: Digital Delivered. They stated that the surface book was new, but I received a call shortly after purchase so they could provide me with an open box Surface Book that was supposably "new" but just opened in a display case. They said it was their last one in stock. Item did not come in original box. Touch screen did not work upon opening. When I tried to call their number back it was disconnected. They provided a free 5 year warranty as part of the "open box" concession, but it was not valid when contacting the warranty company. I have returned via Walmart, but very shady. I believe the laptop was refurbished but advertised as new.
