The proliferation of chemical substances in commerce poses scientific and philosophical problems. The scientific challenge is to develop data, methodologies, and techniques for identifying and assessing toxic substances before they cause harm to human beings and the environment. The philosophical problem is how much scientific information we should demand for this task consistent with other social goals we might have. In this book, Cranor utilizes material from ethics, philosophy of law, epidemiology, tort law, regulatory law, and risk assessment, to argue that the scientific evidential standards used in tort law and administrative law to control toxics ought to be evaluated with the purposes of the law in mind. Demanding too much for this purpose will slow the evaluation and lead to an excess of toxic substances left unidentified and unassessed, thus leaving the public at risk. Demanding too little may impose other costs. An appropriate balance between these social concerns must be found. Justice requires we use evidentiary standards more appropriate to the legal institutions in question and resist the temptation to demand the most intensive scientific evaluation of each substance subject to legal action.

What policy vision will govern the future of technological innovation? Will innovators be forced to constantly seek the blessing of public officials before they develop and deploy new devices and services, or will they be generally left free to experiment with new technologies and business models? In this book, Adam Thierer argues that if the former disposition ("the precautionary principle") trumps the latter ("permissionless innovation"), the result will be fewer services, lower quality goods, higher prices, diminished economic growth, and a decline in the overall standard of living. When public policy is shaped by "precautionary principle" reasoning, it poses a serious threat to technological progress, economic entrepreneurialism, and long-run prosperity. By contrast, "permissionless innovation" has been the secret sauce that fueled the success of the Internet and much of the modern tech economy in recent years, and it is set to power the next great industrial revolution-if we let it.

"A fast and exciting read. . . . This survey of Owsley's career will appeal to both science and legal buffs." --Publishers Weekly The story of the Smithsonian's brilliant forensic anthropologist and the 9,000-year-old skeleton that sparked his landmark lawsuit against the U.S. government When he is not studying ancient skeletons, Doug Owsley is enlisted by the State Department and the FBI to identify remains. He has worked on some of the most notorious tragedies in recent history--Bosnia, Waco, 9/11 and Jeffrey Dahmer's victims among them. When an anthropologist in Kennewick, WA, calls Owsley to help study a 9,000 year-old caucasoid skeleton, he gets caught up in a battle against the Justice Department and Indian tribes who claim the skeleton is Native American and should be buried and not analyzed. Owsley, backed by scientists worldwide, files suit against the government and is now at the forefront of a landmark case--currently pending a ruling in the U.S. District Court--that may alter repatriation laws and have a significant impact on the classic views of Native Americans, migration patterns, and anthropology, as well as our understanding of prehistory.
